How can I fight a false charge?

I posted on CL on the therapeutic side to give massages. I never claimed to be licensed for I clicked the unlicensed box. I would charge normal massage rates. So a guy called me for an appt. for another day. He even called me to confirm his appt. when I didn’t call him to confirm. So I met him at an office location. At this location, I was just hired to be a consultant for their massage products. The business has a license to demonstrate the products through massage. Thus, I don’t have to be licensed or certified. Anyhow, the guy shows up. As I’m massaging him with the massage products, I’m also explaining the benefits of the products and I tell him that I will show him the brochures with all of the different products that he can buy and use at home. Now keep this in mind, draping is optional. He chose to strip down nude and I didn’t ask him to do that. He did that on his own. So, when it came time for him to turn over, I massaged his body. Now as I was making my way up his legs to the thigh area, he started to caress my hips and ***. I moved away from him back towards his feet. Once I came up on the other side and was kneading his thigh, he hopped up and said he was a cop and was busting me for prostitution. He says I touched his genital area, but I didn’t. Masseuses can’t do that! His sargeant and other cronies came into the office and began searching the establishment. What they were looking for I don’t even know. I only had 10 dollars in my purse but I think they were hoping to find condoms, large amount of money, appt. book or whatever but they came up short. So, I was arrested, detained and released with upcoming court dates. Now here’s the killer part, I’m registered to start my cna classes in the next month.
So, I know something isn’t right about this but I just don’t know what and I do not have the money for an attorney. Hell, I working at the place to get money to pay for my upcoming tuition. How on earth can I fight this charge?




First, if you cannot afford an attorney, the Court will appoint an attorney for you. Your attorney will help you, but ultimately it will come down to the District Attorney having to prove their case. From what you have written there, it sounds as though the DA will not have a lot to go on.
Remember that the criminal justice system is like a funnel. A lot of people get arrested, but not everyone that is arrested is ultimately brought to trial and or convicted.
You have the right to a public defender and do not need money. Usually, when they do these stings they have video or audio recordings. So you will have to wait until the PD motions for a MOTION of DISCOVERY to see what proof they have against you.
Hopefully, there is! They will take his word over yours!
Unfortunately, this is not tv and we are not innocent until proven guilty!

eeek! scary…but I don’t get why you didn’t say anything if he started to touch you.
Anyways, did they have a warrent to search? If they didn’t, that’s something you can use against them. Also, is there something wrong at the place you got hired? I mean, maybe your employee was the one with the problems and they just came to search and you were at the wrong place at the wrong time. And have you talked to your employee? What has he/she told you? Maybe they can testify in court saying that they hired you for massaging only. Other than that, you definately need more information before you can fight against this charge- if false, prove them wrong. Anyways, I wish you luck!
